Which state's guide do you need?
Usually the state they lived in, not the one you live in. A few things follow different rules.
- Probate
- Opens in the state that was their permanent home, wherever the family lives now. In Louisiana it's called succession.
- Executor duties
- Follow the probate state. That court appoints the executor and oversees the work until the estate is closed.
- Death certificates
- Come from the state where the death happened. If they died while traveling or in care out of state, order from there.
- A house in another state
- Real estate usually has to pass through a short second case where it sits, called ancillary probate. Read both states' guides.
